Consumer Watchdog Issues Stern Warning to Transport Operators on Fare Hikes

The Federal Competition and Consumer Protection Commission (FCCPC) has issued a strong advisory to inter-city road transport operators, urging them to refrain from implementing arbitrary and unjustified fare increases during the current yuletide travel season. This directive comes in response to a significant uptick in consumer complaints received nationwide.

The Commission, in a statement released by its Director of Corporate Affairs, Ondaje Ijagwu, acknowledged that certain factors, such as heightened seasonal demand, operational challenges, and other justifiable cost considerations, can indeed influence transport pricing. However, the FCCPC emphasized that consumers possess a fundamental right to receive clear, accurate, and timely information regarding fares before commencing their journeys. Furthermore, any adjustments to these fares must be communicated with utmost transparency and applied in a manner that is fair and equitable.

This intervention by the FCCPC occurs against a backdrop of reported decreases in the pump price of premium motor spirit (petrol) in various regions of the country. While acknowledging that fuel costs constitute only one component among many that affect transport fares, the Commission highlighted that unexplained or undisclosed fare hikes raise significant concerns regarding consumer protection.

Mr. Tunji Bello, the Executive Vice Chairman and Chief Executive Officer of the FCCPC, commented on the developing situation, stating that the Commission is actively monitoring market conduct throughout the festive period. He confirmed that the FCCPC has intensified its engagement efforts with transport unions, park managers, and individual operators across the nation.

Bello elaborated that these proactive engagements are designed to be preventive in nature, with the overarching goal of fostering responsible pricing strategies, encouraging voluntary compliance with regulations, and promoting orderly market behaviour.

He clarified that while fare increases are not inherently unlawful, the FCCPC issued a stern warning against practices that could be construed as exploiting consumers or taking undue advantage of the increased demand typically seen during festive seasons. Such exploitative practices, he noted, could attract regulatory action under the provisions of the Federal Competition and Consumer Protection Act (FCCPA) 2018.

Scrutiny on Pricing Practices Intensifies

Further underscoring the Commission’s stance, Bello indicated that specific conduct would be subjected to rigorous scrutiny. This includes, but is not limited to:

  • Inadequate Fare Disclosure: Operators failing to clearly and conspicuously communicate fare information to passengers.
  • Coercive Practices: Actions that pressure consumers into accepting certain fares or conditions.
  • Coordinated Pricing Arrangements: Collusion or agreements among operators to set prices artificially high to the detriment of consumers.

The FCCPC has made it clear that established violations of consumer protection laws will be met with significant penalties.

Traveller Guidance and Reporting Mechanisms

In light of these developments, the Commission has provided actionable advice for travellers intending to undertake journeys during this period:

  • Confirm Fares in Advance: Passengers are strongly advised to verify and confirm the exact fare before boarding a vehicle.
  • Retain Proof of Payment: It is crucial for travellers to keep and retain all receipts or proof of payment for their journeys. This documentation can be vital in the event of a dispute.
  • Report Suspected Unfair Practices: Travellers who encounter or suspect any unfair fare practices are encouraged to report these incidents. The FCCPC offers a dedicated complaints portal at complaints.fccpc.gov.ng for submissions. Alternatively, complaints can be lodged via telephone hotlines at 0805 600 3030 and 0805 600 2020.

The FCCPC’s proactive stance aims to ensure a fair and transparent travel experience for all consumers during the busy holiday season, safeguarding them from potential exploitation by transport operators.
